Wataniya Telecom Maldives Pvt Ltd (“Wataniya”)
provides access to and allows use of this site ('wataniya.mv')
subject to the following terms:
1. By using wataniya.mv you agree to
be legally bound by these terms, which shall take effect immediately
on your first use of wataniya.mv. If you do not agree to be legally
bound by all the following terms please do not access and/or use
wataniya.mv.
2. Wataniya may change these terms at any time by posting changes
online. Please review these terms regularly to ensure you are aware
of any changes made by Wataniya. Your continued use of wataniya.mv
after changes are posted means you agree to be legally bound by
these terms as updated and/or amended.
Use of wataniya.mv
3. You may not copy, reproduce, modify,
transfer, distribute, republish, download, post, broadcast, transmit,
make available to the public, or otherwise use wataniya.mv content
(content includes but is not limited to information, communications,
software, sounds, names images, pictures, logos, icons, apparatus,
product or process) in any form or by any means (including but not
limited to electronic, mechanical photocopying or recording) except
for your own personal, non-commercial use. You also agree not to
adapt, alter or create a derivative work from any wataniya.mv content
except for your own personal, non-commercial use. Any other use
of wataniya.mv content requires the prior written permission of
Wataniya.
4. You understand and agree that you are responsible
for any content that you post or transmit on or through wataniya.mv.
You agree not to cause, nor knowingly allow others to cause, any
nuisance, annoyance, or inconvenience, whether to Wataniya or any
of its customers or users of wataniya.mv by any means.
5. You agree to use wataniya.mv only for
lawful purposes, in a manner consistent with all applicable laws
and regulations and in a way that does not infringe the rights of,
restrict or inhibit anyone else's use and enjoyment of wataniya.mv.
Specifically, you will not use wataniya.mv to post, transmit, distribute,
link to or solicit content that (a) violates or infringes any laws,
regulatory requirements or codes applicable in the Republic of Maldives;
(b) infringes or violates any copyright, trademark or any other
intellectual property, personal or proprietary rights of any person,
or violates any obligation of confidence or any other proprietary
right; (c) contains any obscene, offensive, defamatory or otherwise
actionable material; (d) disrupts the normal flow of dialogue within
wataniya.mv; (e) undermines the security or integrity of wataniya.mv,
including without limitation by importing any viruses, Trojan horses,
time bombs or other disabling devices intended to detrimentally
interfere, damage, surreptitiously intercept or expropriate such
equipment, systems or networks; (f) contains any errors, whether
technical or otherwise; or (g) contains any material in any form
that would otherwise render Wataniya liable or expose Wataniya to
any proceedings whatsoever.
6. You may not use any robot, spider, or other
automatic or manual device or process to monitor or copy our web
pages or any portion of the content contained herein without the
express prior written permission of Wataniya.
7. You may not use any device, software or
routine to interfere or attempt to interfere with the proper working
of wataniya.mv, or to impose an unreasonable or disproportionately
large load on the servers serving wataniya.mv.
8. Wataniya shall have the right (but not
the obligation) in its sole discretion to monitor, refuse or remove
any content that is available via wataniya.mv. Without limiting
the foregoing, Wataniya shall have the right to remove any content
that violates these terms or is otherwise objectionable.

10. Some portions of wataniya.mv may require
that you provide your personal information. Personal information
refers to all and any information relating to you and which will
identify you (including, but not limited to your name, mobile phone
number, e-mail address and mailing address) obtained by us via your

11. You authorise us to disclose your personal
information in the Republic of Maldives and abroad: (a) when we
have your permission; (b) if required to do so by law or by any
order of court; (c) to render assistance to law enforcement, ,government
or regulatory agencies; (d) to comply with any legal process served
on Wataniya; (e) to protect and defend the rights or property of
Wataniya; (f) to act in urgent circumstances to protect the personal
safety of any person; (g) to our associated companies, partners,
agents, debt collection agencies, credit reference or fraud prevention
agencies; or (h) if Wataniya is acquired or merged with another
company.
12. Wataniya may use your personal information
to (a) plan, research, design and market our products and services;
(b) customise the advertising and content you see; (b) fulfil your
requests for products and services; (c) improve our service; (d)
provide you with information about new products, services and offers
from us or selected third parties that we think may be of interest
to you; or (e) contact you.
13. You may opt out of receiving notifications
from us (excludes mandatory communications and notices) about new
products, services and offers from us or selected third parties
that we think may be of interest to you, at any time by setting
your personal preferences when you access your user account or by
informing us at e-mail webmaster@wataniya-maldives.com.

or Submitted to Wataniya
14. You agree to grant to Wataniya a non-exclusive, royalty-free,
worldwide, perpetual license, with the right to sublicense, reproduce,
distribute, transmit, create derivative works of, publicly display
and publicly perform any materials and other information (including,
without limitation, ideas contained therein for new or improved
products and services) you submit to public areas of wataniya.mv
(such as message boards, forums, member profiles, yellow pages,
job folders or other features that allow users to post information
that will be accessible by the public or the user population generally)
by all means and in any media now known or hereafter developed.
You also grant to Wataniya the right (though you acknowledge and
agree that Wataniya shall not be so obliged) to use your name in
connection with the submitted materials and other information as
well as in connection with all advertising, marketing and promotional
material related thereto. You agree that you shall have no recourse
against Wataniya for any alleged or actual infringement or misappropriation
of any proprietary right in your communications to us.
15. Except for any personal, individually
identifying information which we have agreed to keep confidential,
any feedback, data, answers, questions, comments, suggestions, plans,
ideas or the like that you send to us via wataniya.mv, via e-mail
or otherwise, will be treated as being non-confidential and nonproprietary.
We assume no obligation to protect such information from disclosure
and will be free to reproduce, use, and distribute the information
to others without restriction. We will also be free to use any ideas,
concepts, know-how or techniques contained in information that you
send us for any purpose whatsoever including but not limited to
developing, manufacturing and marketing products and services incorporating
such information.

16. wataniya.mv contains hyperlinks to other websites which are
neither maintained nor controlled by Wataniya, or may contain content
posted on or via wataniya.mv by third parties. Wataniya shall not
be responsible for any errors or omissions in any content in wataniya.mv,
or the content, products or services of any hyperlinked website
or any hyperlink contained in a hyperlinked web site, nor for the
privacy and security practices employed by these other website,
and shall not be liable for any loss or damage of any kind incurred
as a result of the use of any content posted or contained in e-mails
or otherwise transmitted or displayed via wataniya.mv, or arising
from access to those websites. Use of wataniya.mv and any hyperlinks
and access to such hyperlinked websites are entirely at your own
risk.
17. You acknowledge that Wataniya has no control
over and excludes all liability for any material on the Internet
which can be accessed by using wataniya.mv. Neither can we be deemed
to have endorsed the content.

or any of the contents are strictly prohibited.
19. Wataniya reserves all rights to disable
any links to, or frames of any site containing inappropriate, profane,
defamatory, infringing, obscene, indecent or unlawful topics, names,
material or information, or material or information that violates
any written law, any applicable intellectual property, proprietary,
privacy or publicity rights.
Disclaimers
and Limitation of Liability
20. You assume total responsibility and risk for your use of wataniya.mv
and the Internet. Wataniya does not make any express or implied
warranties, representations or endorsements whatsoever with regard
to wataniya.mv, any content or any merchandise, information or
service provided through wataniya.mv or on the Internet generally.
All content, merchandise, information or services provided or made
available through wataniya.mv is provided "AS IS" and
on an "IS AVAILABLE" basis and Wataniya shall not be liable
for any cost or damage arising either directly or indirectly from
any such transaction.
21. Under no circumstances will Wataniya be
liable for any loss or damage including but not limited to any of
the following losses or damage (whether such losses were foreseen,
foreseeable, known or otherwise): (a) loss or corruption of data;
(b) loss of revenue or anticipated profits; (c) loss of business
or business interruption; (d) loss of bargain or opportunity; (e)
loss of goodwill or injury to reputation; (f) losses suffered by
third parties; (g) loss of anticipated savings; or (h) any direct,
indirect, consequential, incidental, special or exemplary damages
arising out of or in connection with the use of or implied use of
or resulting from the use of or inability to use wataniya.mv, delays,
inaccuracies or errors in the information or in the transmission
of wataniya.mv, or any information or transactions provided on
or over wataniya.mv or downloaded or hyperlinked from wataniya.mv,
or performance of the contents on wataniya.mv, even if Wataniya
has been advised of the possibility of such damages.
22. Wataniya does not assume any legal liability
or responsibility for the accuracy, completeness, or usefulness

from wataniya.mv and neither does Wataniya warrant that wataniya.mv
will: (a) meet your requirements or will always be accessible; (b)
be uninterrupted, timely, secure and error-free; (c) be free from
computer virus or other invasive or damaging code; (d) that errors
or defects will be corrected; (e) that the results that may be obtained
from the use of wataniya.mv will be accurate or reliable; or (f)
that the quality of any products, services, information, or other

Indemnity
25. You agree to indemnify, defend and hold harmless Wataniya, its
directors, officers, employees, suppliers, licensors, agents, and
any third party content providers, from and against any losses,
damages, claims, costs, expenses, demands, and actions, due to or
arising out of your use of wataniya.mv, your access or connection
to wataniya.mv, your violation of these terms, or your violation
of any rights of another. These obligations will survive any termination
of your relationship with Wataniya or your use of wataniya.mv.
Wataniya reserves the right to assume the defense and control of
any matter subject to indemnification by you, in which event you
will cooperate with Wataniya in asserting any available defenses.

27. Wataniya reserves the right to send you
certain mandatory communications and notices relating to the service
offered by Wataniya, without offering you the opportunity to opt-out

28. Wataniya’s failure to insist upon
or enforce strict performance of any provision of these terms shall
not be construed as a waiver of any provision or right.
29. If any of these or any part of these terms
is held to be illegal, invalid or unenforceable, the unenforceable
part shall be deemed severed and deleted from these terms and the
remaining terms will remain in full force and effect.
30. These terms shall be governed by and interpreted
in accordance with the laws of the Republic of Maldives.
